U.S. District Judge Tanya Chutkan placed a limited gag order on the former president in October after he lashed out on social media against special prosecutor Jack Smith, calling him a thug and deranged.
Judge Millet questioned whether the arguments against the gag order would be any different if Trump were not running for office, and Trump's lawyer stated that their position would still be that the gag order is unconstitutional.
The judges questioned Trump's team on where they would draw the line on calling out or interacting with witnesses during the case.
