"The Federal Insecticide, Fungicide, and Rodenticide Act requires nationwide uniformity in pesticide labels, and prevents Pennsylvania from adding a cancer warning," said Chief Judge Michael Chagares, indicating that states cannot impose stronger labels than the federal standard.
Chip Becker, attorney for the Schaffners, expressed disappointment, stating, "Federal law should not preempt my clients' failure-to-warn claim," emphasizing the ongoing struggle against Roundup's safety narrative despite Bayer's assertions of the product's safety.
Bayer, which has seen its stock tumble over 73% since acquiring Monsanto, stated, "We continue to stand fully behind our brand," signaling confidence despite the legal battles that could escalate to the Supreme Court.
