Plaintiffs filed a class-action suit against Eightfold for allegedly compiling secretive reports that help employers screen candidates and for failing to allow applicants to view or correct information. The suit alleges violations of the Fair Credit Reporting Act and a California consumer protection law. Eightfold assigns candidates a 0–5 AI fit score and reportedly collects personal data including social media profiles, location data, internet and device activity, cookies, and other tracking. Eightfold says it uses data intentionally shared by candidates or provided by customers and denies scraping social media. Widespread use of opaque AI hiring tools raises regulatory and governance concerns.
