His appellate attorneys contend that pretrial publicity and biased juror responses prevented selection of an impartial jury, claiming that 40% of potential jurors had preconceived notions and that at least two jurors lied about forming opinions or posting about the case on social media. The state contends those examples do not prove widespread contamination of the jury pool. A panel of judges has 180 days to decide the motion.
