The California Supreme Court has declined the Portfolio Bar Examination (PBE), ruling it illegal as it does not fulfill the state’s requirement of passing the general bar exam.
The court raised concerns about fairness, noting that a portfolio’s quality could vary significantly depending on the supervising attorney's skill, making it an unreliable assessment of competence.
The court concluded that the PBE would not adequately measure an applicant's issue-spotting skills, as real-world legal scenarios involve unknown factors for both the applicant and the grader.
The PBE's method of indirectly assessing skills, such as client interviews and negotiations, lacks direct observation and reliable evaluation, further diminishing its effectiveness as a competency gauge.
