What trans and nonbinary people need to know about updating their passports and birth certificates

In January, Secretary of State Marco Rubio halted processing passport applications for the X gender marker, reinforcing a transgender exclusion policy from the Trump era. In response, plaintiffs initiated the lawsuit Orr v. Trump with ACLU assistance. A judge's preliminary injunction allowed trans and nonbinary individuals to update their passport gender markers. The injunction was expanded to cover nearly all affected individuals by June. ACLU representatives emphasized the ruling as a significant advancement against discrimination and for equal rights, urging those impacted to utilize the judicial relief temporarily provided.
This decision is a critical victory against discrimination and for equal justice under the law. But it's also a historic win in the fight against this administration's efforts to drive transgender people out of public life.
The State Department's policy is a baseless barrier for transgender, nonbinary, and intersex Americans and denies them the dignity we all deserve.
We encourage all class members impacted by this policy to take advantage of this injunctive relief and we will do everything we can to block this policy permanently.
