Evelyn Parts, a former Swarthmore track and field athlete, has filed a lawsuit against Swarthmore College, athletic officials, and the NCAA for discrimination as a transgender woman. The lawsuit alleges violations of Title IX, emotional distress, and a civil conspiracy. Following a February 6 NCAA ban on transgender women competing in women's sports, which coincided with a federal executive order, Parts argues that her rights were ignored. Parts, who began competing in 2023 after transitioning and recovering from surgery, served as captain of the women's track and field team in 2024.
The lawsuit claims that the defendants violated Parts' Title IX rights, inflicted emotional distress and engaged in a civil conspiracy.
The NCAA banned transgender women from competing in women's sports on Feb. 6, following Trump's executive order to penalize schools allowing such competition.
Evelyn Parts transitioned as a junior in high school, enrolled at Swarthmore in 2020, and became a member of the women's cross country and track teams.
Parts was named as a captain of the women's track and field team in the fall of 2024.
