Judge won't lift her block on Trump admin's anti-trans, anti-nonbinary passport policy

U.S. District Judge Julia Kobick rejected the Trump administration's attempt to implement an anti-transgender passport policy following the Supreme Court's ruling in U.S. v. Skrmetti. Kobick previously issued an injunction preventing this policy, asserting its enforcement against plaintiffs while their lawsuit is in progress. The State Department, aligned with Trump's executive order recognizing only male and female genders, had ceased issuing passports with an X gender marker. Kobick ruled that passports must be issued as they were prior to Trump's presidency, under Biden's expanded options for gender markers.
Kobick stated, 'Whether or not Skrmetti alters the Court's conclusion that the Executive Order effectively imposed an unlawful ban on gender markers for passports remains to be seen.'
In her June ruling, Kobick emphasized that the State Department must start issuing passports as it would have before Trump's administration, allowing pertinent options for trans and nonbinary Americans.
