Gay man says ICE is keeping his husband jailed even though they've agreed to leave the U.S.
"Yes, that's still the plan, that we are going back to Azerbaijan," he said."
"We are waiting for the judge's decision on his voluntary departure back to Azerbaijan," he told The Advocate in an interview. "Even the voluntary departure process is taking too long."
"He already lost 25 pounds," he said. "He can't eat there. His mental health is not good. So he's struggling."
"He's inside, but I'm outside, but I'm living the same situation," Gadirov said. "I'm experiencing the same situation, same feelings."
Samir Gadirov, 30, and his husband Tural Atakishiyev, 40, have agreed to return to Azerbaijan immediately. Atakishiyev has been held at Stewart Detention Center in Georgia since January 14 after being taken into custody during a routine immigration check-in in North Carolina. The couple awaits a judge's decision to allow Atakishiyev to depart voluntarily. One spouse is a legal permanent resident. Atakishiyev has lost about 25 pounds, struggles to eat, and is experiencing declining mental health. The detention has also caused significant emotional strain for Gadirov outside the facility.
