"Guidance which could determine transgender people's right to access the correct single-sex facilities is reportedly being modified to lessen the impact against businesses, the UK's equality watchdog has said. Government sources have said lawyers are working with the Equality and Human Rights Commission (EHRC) to change elements of the code of practice on single-sex service provision that was handed to the Equalities Department last year."
"The proposed updates, brought under former EHRC chair Kishwer Falkner, would have banned trans people from using facilities, such as toilets, consistent with their gender identity and, in some cases, their birth sex too. Sources close to the situation claimed to The Guardian that lawyers for both the EHRC and the government are discussing potential changes to the finalised draft following the appointment of the new EHRC chair, Dr Mary-Ann Stephenson."
Guidance that could determine transgender people's right to access single-sex facilities is being modified to reduce impact on businesses. Government lawyers are working with the Equality and Human Rights Commission (EHRC) to change elements of an unpublished code of practice on single-sex service provision handed to the Equalities Department last year. A draft produced under former EHRC chair Kishwer Falkner would have banned trans people from using facilities consistent with their gender identity and, in some cases, their birth sex. Lawyers for both the EHRC and the government are discussing changes after the appointment of new EHRC chair Dr Mary-Ann Stephenson. Legal rules allow ministers to request amendments only if they reject a submitted draft. More than 650 private organisations warned that a ban on trans access to single-sex spaces would expose businesses to sustained legal risk.
