Web scraper sued by Google claims Google is the one scraping the web
"Just like Google - but at a much smaller scale - SerpApi uses 'automated means' to scrape public websites, which it then synthesizes and makes available to its own customers in ways it believes they will find relevant and useful. This, of course, is exactly what Google does."
"on the backs of others who posted 'the world's information.'"
"the information it scrapes from public websites is not protected by copyright access controls."
Google sued SerpApi in December, accusing the scraper of violating the Copyright Act by using deceptive means to access and scrape search results and bypassing the SearchGuard anti-scraping feature. SerpApi filed a motion to dismiss, contending Google does not hold a copyright in its search results and characterizing Google itself as the largest scraper. SerpApi says it scrapes public websites using automated means, synthesizes results for customers, and that the scraped information is not subject to copyright access controls. SerpApi also argues SearchGuard protects Google's business interests rather than licensed content.
