"These two cases represent a failure on the part of the Supreme Court to provide meaningful guidance to users who need it now," Michel said.
The High Court's failure is due in part to a lack of understanding of market realities and an inability to grasp the basic subject matter, said Michel, and it's indicative of "a systemic problem in this country-not just at the Supreme Court level."
"I think it's not true, because the legislation is carefully enough crafted," Michel explained.
