As CoStar alleges, Zillow copies and displays CoStar images to build unclaimed' property pages, the filing states. With CoStar's images as a draw, Zillow thereby invites property owners to claim' a property and purchase rental listing advertisements. After a user claims' a property and purchases an ad, Zillow provides the same CoStar images for display in a Zillow.com listing."
Zillow filed letters seeking transfer of the case to the Western District of Washington and requesting a pre-motion conference on a motion to dismiss. CoStar alleges that Zillow copies and displays CoStar images to create unclaimed property pages that draw property owners to claim listings and purchase rental advertising. After a property is claimed and an ad purchased, Zillow allegedly uses the same CoStar images in Zillow.com listings and across branded sites and syndication partners. CoStar further alleges Zillow uses those images to power features such as Zestimates, image-feature extraction, user behavior analysis, and recommendations, and defends direct and vicarious infringement claims.
