Education Secretary Linda McMahon is committed to dismantling the Department of Education, following President Trump's directive to close it. Despite her promises of transparency, McMahon has already laid off nearly half of its staff and canceled contracts without congressional input. Experts warn that winding down the department poses legal challenges, as its structure and operations are firmly rooted in federal law, such as the Higher Education Act. McMahon acknowledges the difficulties ahead, seeking clarification on what actions she can legally pursue without congressional approval.
"When [President Trump] asked me to serve as the secretary of education, I knew exactly what his mandate was-to close the Department of Education," McMahon said.
"One of the things I've asked for and is being provided to me is a list of those actions that I can take without Congress, and those that I will need Congress's approval for," she told the radio station.
More than a half dozen higher education scholars...said it will be very difficult for the president to wind down or relocate the majority of the department's operations aside from a few offices.
Most of its structure and services are written into federal laws that dictate the federal role in higher education and the Education Department's responsibilities.
