Secretary of Education Linda McMahon herself stated in the press release announcing the new guidance that "American colleges and universities should be focused on teaching, learning, and research- not influencing elect"
The Department of Education sent a letter to every college and university president warning that participating in or using data from the National Study of Learning, Voting and Engagement (NSLVE) could risk violations of FERPA. FERPA protects the privacy of student education records at institutions receiving Department funds. No department determination has found NSLVE participation to violate privacy statutes. NSLVE, operating since 2013 with over 1,000 participating campuses, matches voluntarily provided enrollment records with public voting files to identify whether students registered and voted, not voting choices. NSLVE uses de-identified data to provide confidential campus reports. The guidance aims to reduce student voting participation.
