"based on non-transparent rules"
"Amazon directly competes with the other marketplace sellers on its platform,"
"Therefore, influencing its competitors' pricing, including through price caps, is only permissible in the most exceptional cases, such as in the event of excessive pricing,"
"directly contradicts the consumer-related standards of EU competition law"
Germany's Federal Cartel Office ordered Amazon to stop implementing price controls on third-party retailers in its German marketplace and to return nearly €59 million in what it deemed unfair gains. Third-party sellers set their own prices, but Amazon reviewed them and could remove products it considered too expensive using non-transparent rules that left retailers unclear how caps were determined. The cartel office said Amazon directly competes with marketplace sellers and that influencing competitors' pricing is only permissible in exceptional cases such as excessive pricing. The watchdog flagged a risk of abuse given Amazon's roughly 60% share of online sales, and the investigation remains ongoing while Amazon plans to appeal.
