The Trump administration's Department of Education has opened an investigation into Denver Public Schools after East High School introduced an all-gender multi-stall restroom. The school argues the restroom, designed with high partitions for privacy, aims to support all students. However, the Department's Acting Assistant Secretary stated the inquiry is to determine if this facility discriminates based on sex, following an anti-trans interpretation of Title IX. Notably, the inquiry was prompted by local media rather than a formal complaint, which DPS has called unprecedented in such investigations.
I hope that DPS and other schools fight back for their students.
It is unheard of for the Office for Civil Rights to admittedly initiate its own investigation, into a single bathroom, as a result of local media coverage.
