Eric Ferguson, 49, faces trial for a rape committed in Oakley, CA in 2002. The victim was allegedly under 18 and was abducted at gunpoint. Ferguson was arrested in Idaho in May 2024, after DNA evidence linked him to the crime. His bail was set at $5 million. The preliminary hearing confirmed sufficient evidence for trial. Ferguson's attorney has filed motions claiming the allegations were fabricated, a claim the judge dismissed, affirming that the case would proceed to arraignment.
According to court documents, the forcible rape charge carries with it two enhancements that the victim was under 18 years old and that Ferguson kidnapped the victim.
Police said he approached her, got out of the vehicle and pointed a gun at her while ordering her into the back seat of the vehicle.
Those DNA samples later led to the arrest, Beard said, indicating the importance of forensic evidence in solving the case.
A 33-page motion filed by Ferguson's lawyer attempted to prove the woman had fabricated the allegations of rape and that it was part of a pattern.
