Corey Dushawn Waters was fatally shot on August 16, 2024, during an altercation in South Berkeley that stemmed from a drug territory dispute. Darnell Anding, who claimed self-defense, received a two-year probation sentence after pleading no contest to gun possession by a felon. Earlier murder charges were dismissed. The preliminary hearing revealed that both men had a prior confrontation where weapons were drawn. Surveillance footage confirmed Waters entered the building with a gun, allegedly looking for Anding, establishing the self-defense argument made by Anding's attorney.
Anding told police that Waters had come through a door to the attic aiming a gun and looking for him, according to court records.
Anding's attorney made a successful argument for self-defense at a preliminary hearing in March.
Both charges stemmed from the Aug. 16 death of 52-year-old Corey Dushawn Waters, whom police said had been in an ongoing dispute with Anding over territory for drug sales.
Surveillance video showed Waters drawing a gun as he entered the building, around 12:30 p.m.
