Van driver avoids prison for fatal crash on malfunctioning smart motorway
"Judge Amjad Nawaz stated that the absence of warning lights should not detract from a driver's duty to remain alert at all times. Every driver owes the duty of care to other users, and the lack of warning lights does not diminish that responsibility."
"The prosecution highlighted that O'Sullivan failed to notice cues indicating the vehicle was stationary, including other motorists taking evasive actions. The judge noted that O'Sullivan's driving exhibited a lack of attention and suggested there was some form of distraction."
Barry O'Sullivan was sentenced to six months' imprisonment, suspended for 12 months, after being found guilty of causing the death of Pulvinder Dhillon by careless driving. The incident occurred on 7 March 2022 when O'Sullivan crashed into a stationary Nissan Micra on the M4. Dhillon, a passenger in the Micra, suffered fatal injuries. A technical failure on the smart motorway had prevented alerts for broken-down vehicles from being communicated. The judge emphasized that drivers must remain alert regardless of warning signals.
