A jury last August assigned two-thirds of the blame to the driver and one-third to Tesla, and awarded punitive damages solely against Tesla. The crash in Florida killed Naibel Benavides and critically injured Dillon Angulo. The judge found Tesla's post-trial grounds virtually identical to earlier arguments raised during trial and summary judgment, and determined that Tesla did not present additional arguments or controlling law to alter prior rulings or the jury verdict. Tesla argued the driver bore primary blame.
