California's long-standing law allowing undocumented high school graduates to access in-state tuition is under threat due to recent federal lawsuits aimed at similar policies in Texas and Kentucky. Since its implementation in 2001, Assembly Bill 540 has granted many undocumented students access to higher education. However, legal actions from the Trump administration and the Department of Justice have created uncertainty, leaving many students fearful about the continuity of these benefits amidst claims that they violate federal laws regarding public benefits for undocumented individuals.
"Under federal law, schools cannot provide benefits to illegal aliens that they do not provide to U.S. citizens," Atty. Gen. Bondi said of the Texas lawsuit in a statement."
"California has allowed undocumented immigrants to receive in-state tuition for 24 years, providing access to higher education for many who could not afford it otherwise."
