"The notice purported to because there was a fire, I believe, it's stated that all leases are hereby terminated. And that stood out to me because that is just patently against the law,"
"It's not legal in the city of Oakland to try to terminate tenancies in such a way,"
"There is there is a possible notice that could have been served, which would require the tenants to vacate. But they would have the right to return."
"Here's what you need to know. Don't sign anything without, you know, running it by an attorney,"
A three-alarm fire in Oakland displaced dozens of residents and prompted landlords to allegedly serve notices terminating all leases. The Oakland City Attorney referenced a document notifying tenants that "all leases are herby terminated." Tenants' rights attorney David Hall said terminating tenancies in that manner is illegal in Oakland and that a notice to vacate, if issued, would still leave tenants with the right to return. Landlord Ted Dang referenced a tenant he was evicting and suggested that tenant or a guest may have started the fire. The Oakland Fire Department is investigating. Tenants were advised not to sign documents without consulting an attorney.
