"What happens if I am driving in a carpool lane during restricted hours with no passengers after that? The CHP can pull you over and write you a ticket. Violations of California's carpool lanes, also known as diamond lanes, or high-occupancy vehicle (HOV) lanes, carry fines of $490. Starting October 1, 2025, you must obey the posted vehicle occupancy requirement to travel in the carpool (HOV) lane or risk receiving a citation and fine, the California Department of Motor Vehicles said in a statement."
The Clean Air Vehicle decal program expires statewide at midnight on Sept. 30, ending nearly 25 years of carpool-lane privileges for electric vehicles. After expiration, law enforcement can stop drivers using carpool (HOV) lanes without meeting occupancy requirements and issue citations. Violations carry fines of $490, and beginning October 1, 2025 drivers must follow posted vehicle occupancy rules to use HOV lanes. The federal Fixing America's Surface Transportation Act (2015) allowed states to grant HOV access to EVs, but that permission expires Sept. 30 and has not been reauthorized by Congress.
