"This was a meritless lawsuit fueled by Washington Democrats claiming our district disenfranchises minorities in an effort to take out the first minority to represent the district and steal our seat,"
"We are appealing this decision and will continue to use every legal option at our disposal to protect the voices of the people of Staten Island and Brooklyn and are very confident that we will prevail at the end of the day."
"Petitioners have also shown through testimony and empirical data that the history of discrimination against minority voters in CD-11 still impacts those communities,"
Judge Jeffrey Pearlman ruled New York's Congressional District 11 map unconstitutional and ordered it redrawn, citing testimony and empirical data about historical discrimination against minority voters. Representative Nicole Malliotakis, who has held the seat since 2021, announced an appeal and characterized the lawsuit as meritless and politically motivated by Washington Democrats. Malliotakis accused a judge with prior ties to Kathy Hochul of attempting to silence district voters and said she will use all legal options to defend the district. Appeals were filed on Jan. 27 in the New York Appellate Division and the Court of Appeals. The contested map covers Staten Island and parts of southwestern Brooklyn, and the proposed redrawing would pair Staten Island with lower Manhattan, potentially altering current Brooklyn neighborhoods.
