GOP appeals decision that could cost Malliotakis her seat
"BAY RIDGE - A GROUP OF REPUBLICANS on Monday launched an appeal of a court decision last week to throw out the boundaries of U.S. Rep. Nicole Malliotakis' 11th Congressional District, which includes parts of southern Brooklyn and Staten Island, reports the Associated Press. Supreme Court Justice Jeffrey Pearlman had ruled that the district's boundaries, which had been drawn by a special master after an unsuccessful Democrat-led redistricting map was shut down by the courts in 2021, unconstitutionally disenfranchised Black and Latino voters."
"The group appealing, comprised of Malliotakis as well as members of the state Board of Elections and district voters, filed in both the State Supreme Court and the State Court of Appeals, and is seeking a pause on Pearlman's ruling that would allow the current boundaries to be used this fall, according to The Hill. Attorney Bennet Moskowitz, who represents Malliotakis, said they plan to appeal to the U.S. Supreme Court if the pause is not granted by Feb. 10."
A judge found the 11th Congressional District boundaries unlawful because they disenfranchised Black and Latino voters and ordered a commission to redraw the map by Feb. 6 ahead of the midterm cycle. The redrawing could convert the formerly purple district into a competitive seat for Democrats. The appeal was filed by the incumbent, members of the state Board of Elections and district voters in both state trial and appellate courts seeking a stay that would preserve current boundaries for the fall election. The appeal seeks expedited relief and contemplates U.S. Supreme Court review if a pause is not granted by Feb. 10.
