Tesla's water supply and wastewater disposal agreement with the Strausberg-Erkner Water Association (WSE) is at risk due to the WSE's unapproved modifications. Initially agreed upon after lengthy negotiations, the changes involve special termination rights and water quantity clauses that WSE altered without Tesla's consent. Tesla's Giga Berlin plant is already utilizing significantly less water than anticipated, but the recent adjustments to the contract have led Tesla's management to refuse signing until clarity is achieved. A meeting is scheduled for early March to seek resolution on the matter.
These are changes in the annexes to the actual resolution agreement, and specifically changes in the special termination right and the water quantities, which could be adjusted unilaterally by the WSE. This is not related to the agreements we made together in the one and a half years of negotiations. As things stand, we are therefore not prepared to sign it.
Tesla says - and this is entirely understandable - that WSE association chairman Mr. Bähler has now introduced clauses that were not agreed upon. However, this cannot be clarified now because more time is needed. We will see that we clarify this by March 5th.
