California District Judge Yvonne Gonzalez Rogers ruled against an 'all or nothing' motion filed by Meta, ByteDance, Alphabet and Snap to dismiss the suits, allowing the case to proceed to trial.
The judge ruled that the social media companies are not immune from the suit's allegations under the First Amendment or Section 230, a law that provides some protection for online platforms hosting third-party content, stating that the platforms are 'more than mere message boards or search engines.'
At least three dozen states, including California and Texas, specifically sued Meta and Instagram, alleging that Meta knowingly made Instagram addictive for children and that the company did so despite knowing it could cause young people harm.
