An Army veteran was sentenced to three years in prison Thursday after being convicted of seditious conspiracy in connection with the Oath Keepers' sprawling plot to stop the certification of Joe Biden's 2020 victory, which culminated in the January 6, 2021, riot at the US Capitol.Edward Vallejo, who was affiliated with the Oath Keepers but not a member of the far-right militia, was one of the alleged leaders of the armed, so-called quick reaction force staged just outside of Washington, DC, on January 6.

Dan "Milkshake" Scott pled guilty to obstruction and assault yesterday.He faces 41 to 63 months of prison.His plea does not include a cooperation agreement, so unless DOJ has kept that hidden in some way (everything about the Proud Boy cases is weird, so I don't rule it out, and his plea also does not include the standard cooperation paragraph, which often means someone has already been interviewed), Scott will not be called as a witness in the Proud Boy leader trial to explain why he yelled, "Let's take the fucking Capitol" two hours before the Proud Boys did just that.

The government and the defense team for Douglass Mackey, the Twitter troll accused of conspiring to convince Hillary Clinton voters to throw away their vote in 2016, are fighting over what evidence will come in at trial, which is currently scheduled to start on March 16.As I have laid out, campaigns like the one Mackey is alleged to have conducted with people including Anthime "Baked Alaska" Gionet, are the reason why the FBI sends Twitter lists of accounts lying about the place or means of voting: The FBI is trying to stop systematic attempts to dupe people out of exercising their right to vote.

The other day, I noted that while I agree with Rayne that the January 6 Committee could use referrals to make important symbolic statements, the Committee's referral, in practice, was weaker than it should have been to make that symbolic impact.That made bmaz' earlier gripes about such a referral look more justified.

A 2PM Eastern today, an 11th Circuit panel including William Pryor, Britt Grant, and Andrew Brasher will consider DOJ's expedited motion to overturn Judge Aileen Cannon's decision to appoint a Special Master.Oral arguments should be available here.The briefs are here:
Grant and Brasher were on the panel that already held that Cannon erred in intervening given that there was no evidence of callous disregard for Trump's rights, so I fancy DOJ's chances.

To my mind, the best part of appointing war crimes and public corruption prosecutor Jack Smith as Special Counsel to oversee the twin investigations into Donald Trump is that it will be a cinch, now, to subpoena Ginni Thomas.Otherwise I have mixed feelings about the decision.I think the letter of DOJ guidelines requires it.
