Brazil used the article to formally recognize that Israel is violating the Genocide Convention of 1948. South Africa and Israel are now invited to furnish written observations on the declaration of intervention, the World Court said."

Brazil filed a declaration of intervention at the International Court of Justice under Article 63, joining South Africa's case alleging genocide in Gaza. The declaration invokes the 1948 Genocide Convention and alleges Israel is violating that treaty. The ICJ invited South Africa and Israel to submit written observations on Brazil's intervention. Brazil announced its intent in July, citing impunity and denouncing Israeli actions in Gaza and the occupied West Bank. Spain, Ireland, Mexico, Turkiye and other states intervened in support of South Africa. The ICJ issued an interim order in January 2024 obliging Israel to prevent acts of genocide, allow humanitarian access, and ruled Israel's presence in occupied Palestinian territory unlawful.
