Senate Joint Resolution 3 passed the Virginia Senate 26-13 to remove a 2006 constitutional provision defining marriage as only between a man and a woman. The resolution would prohibit the state from denying marriage licenses or failing to recognize lawful marriages on the basis of sex, gender, or race. A proposed constitutional amendment requires approval by two successive legislatures before appearing on the ballot; both chambers approved the resolution in 2025 and the House approved it again, so the amendment will be placed before voters in November 2026. The 2006 ban has been unenforceable since Obergefell (2015), and 2024 legislation codified same-sex marriage in Virginia.
