A New York appeals court found the monetary disgorgement ordered against Donald Trump excessive and unconstitutional under the Eighth Amendment, voiding nearly half a billion dollars in penalties. A lower judge previously determined that Trump overstated his wealth, resulting in an original $354 million penalty that rose to about $515 million with interest. The appeals court accepted injunctive relief designed to curb business practices but rejected the large monetary award. Trump celebrated the ruling on Truth Social, called the case a political and business "witch hunt," and noted that over $550 million had been at issue.
While the injunctive relief ordered by the court is well crafted to curb defendants' business culture, the court's disgorgement order, which directs that defendants pay nearly half a billion dollars to the State of New York, is an excessive fine that violates the Eighth Amendment of the United States Constitution, Judges Dianne T. Renwick and Peter H. Moulton wrote in one of several opinions shaping the appeals court's ruling.
