"The U.S. Patent and Trademark Office (USPTO) has proposed that would effectively end the public's ability to challenge improperly granted patents at their source-the Patent Office itself. If these rules take effect, they will hand patent trolls exactly what they've been chasing for years: a way to keep bad patents alive and out of reach. People targeted with troll lawsuits will be left with almost no realistic or affordable way to defend themselves."

Proposed USPTO rule changes would curtail the public's ability to challenge improperly granted patents through inter partes review (IPR), effectively protecting bad patents from scrutiny. Eliminating or restricting IPR would enable patent trolls to keep abusive patents enforceable and increase litigation leverage against targeted individuals and small entities. The proposal includes a fast-moving public comment period with a December 2 deadline, urging affected parties and supporters to submit comments under their real names. Comments can be brief and nontechnical. A sample comment opposes Docket No. PTO-P-2025-0025 and defends keeping IPR open, fair, and merit-based to protect innovation.
