Texas and Florida filed a federal lawsuit in Wichita Falls challenging FDA approvals of mifepristone, including Evita Solutions' newly approved generic. The Republican attorneys general allege the FDA has not thoroughly evaluated the drug's safety and effectiveness since its 2000 approval and ignored risks to women. The complaint also contests regulations adopted under former presidents Barack Obama and Joe Biden and alleges the FDA acted arbitrarily, capriciously, contrary to federal law, or beyond its powers under the Administrative Procedure Act.
