Texas AG Ken Paxton says ban on gender-affirming care for trans kids also applies to talk therapy

Texas Attorney General Ken Paxton issued a legal opinion interpreting a 2023 state law to prohibit mental health professionals, including psychologists, family therapists, and social workers, from providing any care related to gender transition for minors. This interpretation extends beyond medical procedures to encompass all mental health support. The opinion directly contradicts guidance from major U.S. medical organizations including the American Medical Association, American Academy of Pediatrics, and American Psychological Association, which recognize mental health counseling and psychological support as essential components of gender-affirming care. Research shows suicide attempt rates among transgender youth have increased significantly, with the sharpest increases among those under 18.
