Miller cited the Constitution's allowance for this suspension during times of invasion, suggesting it is an option under active consideration. He emphasized that the decision would heavily rely on whether judicial authorities support the administration’s stance on immigration enforcement.
"Well, the Constitution is clear, and that, of course, is the supreme law of the land, that the privilege of the written habeas corpus can be suspended in a time of invasion," Miller said.
"So that's an option we're actively looking at. Look, a lot of it depends on whether the court will do the right thing or not."
