Jenkins emphasized preparedness and warned that unlawful conduct by federal agents will not be tolerated and could prompt criminal charges. She identified potential murder and excessive force charges where use of force appears unjustified. Building cases against law enforcement officers presents challenges, including access to evidence. Congressman Sam Liccardo said the Department of Homeland Security has blocked local access to evidence in the Alex Pretti shooting and described that obstruction as highly unusual.
