Rod Rosenstein expressed detailed support for the Hur report’s conclusion that prosecution of Biden was not warranted, noting the report’s length and dense documentation. The Hur report had been public for only three days when Rosenstein showed notable familiarity with it. Rosenstein earlier participated in drafting the Barr memo that declined prosecution of Trump but did not address pardon-related conduct highlighted in Volume II of the Mueller investigation. Under pressure from Senator Lindsey Graham, Rosenstein broadened the investigation’s scope and publicly accepted Graham’s characterization minimizing evidence regarding Flynn, Carter Page, and Papadopoulos.
