Senator John Kennedy said the president does not decide whether federal workers receive back pay and that Congress must appropriate the money. He told reporters to "Read the Constitution." A draft White House memo reportedly suggested furloughed federal workers might not be guaranteed compensation under existing law. Kennedy noted that back pay has historically been provided to military and federal workers and said, in his opinion, Congress will appropriate funds again. Kennedy said he had not read the memo and directed questions about its legality and content to the White House.
