
"Making it easier to terminate such associations is one of several eyebrow-raising ideas in a comprehensive bill, HB 657, that Porras recently filed in advance of the legislative session that begins Jan. 13. Opposition is likely. In a statement from an influential trade group, Community Associations Institute, CEO Dawn Bauman said the group is "closely assessing and engaging" with the bill. But it added that a vast majority of associations are "well run" and that 86% of homeowner rate their experience as very good, good or neutral."
"Porras, in an interview with the South Florida Sun Sentinel, said his bill was "the culmination of years of frustrating meetings, calls and emails from homeowners, especially in the district I represent in Southwest Miami-Dade." He added that he has spoken with fed up homeowners "from Pensacola to the Keys" who don't know where to turn for solutions to their HOA and condo board problems."
State Rep. Juan Carlos Porras filed HB 657 to make it easier for homeowners to dissolve homeowners associations and condo governing bodies. The bill would simplify the current termination process that requires hiring a trustee, filing a termination plan in public records, and obtaining approval from at least 75% of homeowners. Porras said the proposal responds to widespread homeowner complaints across Florida and cited fraud allegations in some communities. The Community Associations Institute cautioned that most associations are well run and noted that dissolving an HOA is already possible under current law while it assesses the bill's potential impacts. The bill was filed ahead of the legislative session beginning Jan. 13 and faces likely opposition from trade groups concerned about homeowner protections and community stability.
