Prosecutors ready to move forward with Harvey Weinstein retrial, they say

A mistrial occurred in Harvey Weinstein's second trial due to juror misconduct, leading to a decision for a third trial on a third-degree rape charge involving Jessica Mann. Mann claims she was raped in 2013 and nonetheless maintained a relationship with Weinstein. In the previous trial, Weinstein was convicted of a criminal sexual act against one accuser and acquitted against another. The New York court had previously overturned a prior conviction, impacting the admissibility of testimony from unrelated accusers. The judge expressed urgency for the upcoming trial to commence this year.
"Rape can happen in relationships -- and in dynamics where power and manipulation control the narrative," Mann said in a statement after the second trial ended in a mistrial.
Weinstein was convicted of criminal sexual act against Miriam Haley and found not guilty of criminal sexual act against Kaja Sokola.
The trial will take place after Weinstein's second ended with a partial verdict, and a mistrial in June, after the jury foreperson said he was threatened by another juror.
New York's highest court overturned Weinstein's 2020 conviction last year, ruling the judge in his first trial should not have allowed testimony from accusers who were not part of the criminal charges.
