Comey and James filed motions to dismiss their prosecutions arguing that Halligan's installation was unlawful. Halligan lacks prosecutorial experience and had been appointed after being tasked with legal work for the president. The retroactive appointment appears aimed at preserving Halligan's authority even if a court voids the original installation.
