The latest amendment to McMurray's contract makes it an evergreen contract, said Cole."
"The amendment also establishes an election window period a one-year span that begins six months before and ends six months after a new council is seated during which McMurray cannot be terminated without cause. During that period, a council supermajority or four-fifths vote would be required for any termination for cause. Any termination without cause outside of the election window period would also require a supermajority vote."
Oakley City Council approved amendments to City Manager Joshua McMurray's employment contract in a 4-1 vote on Oct. 28, with one dissenting councilmember. The contract was converted to an evergreen agreement that remains in place until terminated by McMurray or the council under specified conditions. A one-year election window beginning six months before and ending six months after a newly seated council bars termination without cause; terminations during that window for cause require a four-fifths supermajority, and terminations without cause outside the window also require a supermajority. The council authorized up to $25,000 for McMurray's legal expenses related to a workplace investigation. Severance if terminated without cause increased from 11 to 18 months. Since November 2021 the contract has been amended four times, primarily to increase salary, severance, and extend the contract.
