Nice! Texas to Let Texans Sue Abortion Pill Distributors
"HB 7 (ironically titled "The Women and Child Protection Act") would further threaten reproductive healthcare in the state by allowing any private citizen to sue anyone trying to send abortion pills into Texas (specifically: anyone who "manufactures, distributes, mails, transports, delivers, prescribes, or provides" it). After it passed, state Senator Bryan Hughes (R), who sponsored the bill, said it would protect pregnant women from "poisonous, illegal drugs." (Unsurprisingly, Sen. Hughes is the same villain who authored Texas's abortion ban in 2021.)"
"Previous legislation also hasn't stopped providers in places like California or New York-who are protected by their own states' shield laws-from mailing in abortion pills. But under HB 7, pregnant people, the person who impregnates them, and close relatives can collect the entire $100,000 for turning in the accused. Women who take the abortion pill cannot sue or collect the money for any reason."
HB 7 allows private citizens to sue anyone who manufactures, distributes, mails, transports, delivers, prescribes, or provides abortion pills into Texas. The law enables pregnant people, the person who impregnates them, and close relatives to collect $100,000 for reporting an accused individual; unrelated filers can collect $10,000 while $90,000 would be donated to an unspecified charity. Women who take abortion pills cannot sue or collect damages. Doctors and hospitals in Texas are exempt from suit. Sponsors frame the pills as "poisonous, illegal drugs" and aim to deter providers and patients from accessing medication abortion.
