The most serious breach involved a tracking device hidden in the child's car seat, discovered after a relative received an alert on their phone. The tracker incident was described as 'particularly insidious,' raising concerns about a pattern of behavior posing a risk to the complainant.
Detective Sergeant Ruth Finnegan stated in court that the tracking device was similar to an 'AirTag-type device.' The court heard that the accused allegedly admitted to a relative about planting the tracker after borrowing the child's car seat to facilitate a custody exchange. This behavior contributed to the serious nature of the breaches of the safety order.
The court documented that the accused has been in a relationship with the complainant for almost a decade, sharing children, and that she secured a two-year safety order in April 2025. Despite this, he allegedly sent about 50 emails a day over three consecutive days, some abusive, which led her to block his email address. The complainant expressed her fears for her safety, stating, 'He won't stop contacting me or intimidating me.'
Judge McNamara characterized the tracker incident as a worrying indication of the accused's behavior.
