"The bill would make it "unlawful for any covered immigration officer to acquire, possess, access, or use in the United States-(1) any biometric surveillance system; or (2) information derived from a biometric surveillance system operated by another entity." All data collected from such systems in the past would have to be deleted. The proposed ban extends beyond facial recognition to cover other biometric surveillance technologies, such as voice recognition."

Senate Democrats proposed the ICE Out of Our Faces Act to prohibit ICE and CBP from acquiring, possessing, accessing, or using biometric surveillance systems in the United States. The prohibition covers biometric systems broadly, including facial and voice recognition, and also bans use of information derived from systems operated by other entities. Agencies would be required to delete all previously collected biometric data. The bill bars federal use of biometric surveillance data in investigations or court proceedings. Individuals could sue for financial damages after violations, and state attorneys general could pursue suits on behalf of residents. The bill lists Sen. Edward J. Markey as sponsor and includes several cosponsors and supporters.
