Letitia James' office filed an amicus brief asking the U.S. District Court for the Southern District of New York to bar ICE from detaining immigrants inside courthouses. The brief challenges policies that permit arrests while men, women and children attend mandated court hearings. Reporting documented masked ICE agents waiting in halls of 26 Federal Plaza and 290 Broadway and detaining people as they leave courtrooms. One immigrant said she was too afraid of ICE to attend a hearing in person. The brief warns that courthouse arrests sow fear, deter testimony and orders of protection, hinder prosecutions, and undermine public safety.
Courthouses are dedicated to the pursuit of justice, not targeted harassment and arrests, James said. With these cruel and unlawful courthouse arrests, the federal government is weaponizing fear to push immigrants into the shadows, drive families apart, and risk everyone's safety. I will not stand by while New Yorkers are stripped of their rights and our courts are used for intimidation.
