The American Federation of Government Employees filed suit against the Trump administration over automated out-of-office email responses placed on many furloughed employees' accounts during the government shutdown. The messages were applied without employee consent and attributed blame to Senate Democrats for the shutdown. The union will be represented by Democracy Forward and Public Citizen Litigation Group. The complaint contends the messages constitute partisan political rhetoric and violate the Hatch Act's nonpartisanship requirement for nonappointed government staff. The complaint also alleges violations of individual employees' First Amendment rights and seeks immediate court action to halt the practice.
