Siebert's office told the officials that it hadn't found sufficient evidence to charge James, said the person."

The U.S. Attorney for the Eastern District of Virginia, Erik Siebert, reviewed the allegations and determined there was insufficient evidence to bring charges. Bloomberg Law reports that Siebert is being removed from his position after declining to prosecute. Administration officials had requested prosecution, and Siebert's office communicated the lack of evidence to those officials.
