Federal Appellate Court Obliterates Trump Admin's Arguments Against Birthright Citizenship
"The U.S. Court of Appeals for the First Circuit dropped a legal smackdown on President Donald Trump's efforts to revoke birthright citizenship, eviscerating the administration's arguments in a 100-page opinion. One of the first executive orders Trump signed to kick off his second term was one that purported to end birthright citizenship. It was swiftly challenged in court by multiple plaintiffs in multiple states and by several blue state governments as well."
"In June, the Supreme Court rolled back the ability of lower federal courts to issue nationwide injunctions blocking the executive order from being implemented, but the various court proceedings have put injunctions back in effect, including a July ruling from a three-judge panel on the 9th Circuit Court of Appeals that issued an injunction blocking the Trump administration from denying citizenship to people born in the U.S. to parents who are here illegally or temporarily."
The First Circuit issued a 100-page opinion decisively rejecting the administration's attempt to terminate birthright citizenship. A three-judge panel led by Chief Judge David J. Barron emphasized the Fourteenth Amendment clause that grants citizenship to persons born or naturalized in the United States and referenced the Immigration and Nationality Act containing similar language. The executive order to end birthright citizenship faced immediate multi-state and private challenges. The Supreme Court limited nationwide injunctions in June, but subsequent lower-court rulings, including a Ninth Circuit injunction, have kept parts of the executive order blocked.
